<p class="wp-block-paragraph"><strong>In my today&#8217;s blog, I will let you know about section 194J of the Income Tax Act.</strong></p>



<p class="wp-block-paragraph"><strong>What is it?</strong></p>



<p class="wp-block-paragraph">Section 194J of the Income Tax Act, 1961, mandates the Tax Deduction at Source (TDS) on payments made for professional or technical services rendered by resident individuals or Hindu Undivided Families (HUFs). TDS acts as an advanced tax collection mechanism, ensuring timely government revenue collection and reducing tax evasion.</p>



<p class="wp-block-paragraph"><strong>Who is Liable to Pay?</strong></p>



<ul class="wp-block-list">
<li><strong>Deductor:</strong> Any person (other than an individual or HUF) making payments for professional or technical services in India is liable to deduct TDS at source. This includes companies, firms, partnerships, associations, trusts, local authorities, government bodies, etc.</li>



<li><strong>Payee:</strong> The recipient of the payment for professional or technical services (a resident individual or HUF) is liable to pay income tax on the entire amount received, including the deducted TDS.</li>
</ul>



<p class="wp-block-paragraph"><strong>Who is Responsible for Deduction?</strong></p>



<p class="wp-block-paragraph">The deductor is solely responsible for withholding TDS at the prescribed rate, depositing it with the government treasury by the specified due date, and filing TDS returns electronically. Failing to comply with these obligations attracts penalties and interest.</p>



<p class="wp-block-paragraph"><strong>What Services Are Covered?</strong></p>



<p class="wp-block-paragraph">Section 194J applies to a broad range of professional and technical services, including:</p>



<ul class="wp-block-list">
<li>Legal services (advocates,&nbsp;solicitors,&nbsp;chartered accountants,&nbsp;etc.)</li>



<li>Engineering services (architects,&nbsp;civil engineers,&nbsp;software engineers,&nbsp;etc.)</li>



<li>Medical services (doctors,&nbsp;dentists,&nbsp;consultants,&nbsp;etc.)</li>



<li>Management consultancy</li>



<li>Technical consultancy</li>



<li>Auditing services</li>



<li>Financial services (investment advisors,&nbsp;tax consultants,&nbsp;etc.)</li>



<li>Royalties for use of intellectual property (films,&nbsp;music,&nbsp;literary works,&nbsp;etc.)</li>



<li>Payments to directors for specific services (excluding regular salary)</li>
</ul>



<p class="wp-block-paragraph"><strong>Threshold Limit and Applicability</strong></p>



<ul class="wp-block-list">
<li>TDS deduction under Section 194J is mandatory if the aggregate payment for professional or technical services to a resident payee exceeds&nbsp;<strong>₹30,000</strong>&nbsp;during a financial year.</li>



<li>This threshold applies separately to each payee and each type of service,&nbsp;meaning even separate payments below ₹30,000 can collectively trigger TDS if they cross the limit from the same payee for the same service.</li>
</ul>



<p class="wp-block-paragraph"><strong>TDS Rates and Exemptions</strong></p>

<li><strong>Standard Rate:</strong>&nbsp;10% of the gross payment is deducted unless specific exemptions or lower rates apply.</li>



<li><strong>Lower Rate (2%):</strong> Applies to:
<ul class="wp-block-list">
<li><strong>Technical services (not professional services):</strong>&nbsp;Includes engineering,&nbsp;architectural,&nbsp;drafting,&nbsp;designing,&nbsp;data processing,&nbsp;consultancy,&nbsp;or supervision related to these activities.</li>



<li><strong>Royalties in the nature of consideration for cinematographic films:</strong>&nbsp;Payments to artists,&nbsp;musicians,&nbsp;or authors for rights to use their work in films.</li>
</ul>
</li>



<li><strong>Exemptions:</strong> Certain categories are exempt from TDS under Section 194J, such as payments made to:
<ul class="wp-block-list">
<li>Government departments</li>



<li>Local authorities</li>



<li>Public sector undertakings</li>



<li>Universities and educational institutions</li>



<li>Hospitals and charitable institutions</li>



<li>Payments for legal services rendered by a lawyer to his/her client in any court or tribunal established by law</li>



<li>Payments for professional services received by an individual or HUF whose gross receipt from profession or business in the preceding financial year did not exceed ₹1 crore (companies) or ₹50 lakh (individuals/HUFs)</li>
</ul>
</li>
</ul>



<p class="wp-block-paragraph"><strong>Penalties and Interest for Non-Compliance</strong></p>



<ul class="wp-block-list">
<li><strong>Failure to deduct or deposit TDS:</strong>&nbsp;A penalty of 100% of the tax deducted but not deposited,&nbsp;subject to a minimum of ₹10,000.</li>



<li><strong>Late filing of TDS returns:</strong>&nbsp;Late filing fee of ₹10,000.</li>



<li><strong>Interest on delayed payment:</strong>&nbsp;Simple interest at 1.5% per month on the tax amount from the due date to the date of payment.</li>
</ul>



<p class="wp-block-paragraph"><strong>Advantages and Disadvantages</strong></p>



<p class="wp-block-paragraph"><strong>Advantages:</strong></p>



<ul class="wp-block-list">
<li><strong>Revenue collection:</strong>&nbsp;Ensures timely government revenue collection and reduces tax evasion.</li>



<li><strong>Advance tax payment:</strong>&nbsp;Payees prepay tax through TDS,&nbsp;reducing their final tax liability.</li>



<li><strong>Transparency:</strong>&nbsp;Creates a record of transactions,&nbsp;enhancing transparency and accountability.</li>
</ul>



<p class="wp-block-paragraph"><strong>Disadvantages:</strong></p>



<ul class="wp-block-list">
<li><strong>Compliance burden:</strong>&nbsp;Increases administrative burden for deductors,&nbsp;especially small businesses.</li>



<li><strong>Cash flow impact:</strong>&nbsp;Deducted TDS reduces immediate cash flow for payees.</li>



<li><strong>Potential errors:</strong>&nbsp;Incorrect deductions or deposits can lead to penalties and financial losses.</li>

<h4 class="wp-block-heading">What is DRC-03?</h4>



<p class="wp-block-paragraph">DRC-03 Form is implemented by the GST department for the payment of interest and Liabilities. and this is a voluntary tax payment form that is issued by the GST department to their GST holders.</p>



<p class="wp-block-paragraph">If any GSTIN holder who did not pay his own taxes to the GST department, then the GST department issues show-cause notice to their GSTIN holder for the payment of interest and liabilities.</p>



<h4 class="wp-block-heading">What is the reason a taxpayer makes payment in DRC-03</h4>



<p class="wp-block-paragraph"><strong>There are different cases for a taxpayer to pay their tax with the help of the DRC-03 form.</strong></p>



<ul class="wp-block-list"><li><strong>ITC Mismatch</strong> &#8211; When the GST department starts conducting the audit. If he finds any mismatch in taxes, then he issues a show cause notice to that type of GSTIN holder for the payment of interest and liabilities at the earliest. if the GSTIN holder avails the excess ITC for the payment of their tax then the GST department will issue a show-cause notice for the payment of its interest and liabilities.</li><li><strong>Liability Mismatch</strong> &#8211; If any GSTIN holder had not paid their taxes according to GSTR-3B and the GST department would be known then he would issue a show-cause notice to that type of GSTIN holder.</li><li><strong>Any demand</strong> <strong>/ Voluntary  </strong>&#8211; when we received any notice from the GST department for non-payment of taxes or shortfall in taxes then due to this type of mistake we would have to pay our taxes with the help of the DRC-03 form.</li><li><strong>Annual return </strong>&#8211;<strong> </strong>When we are preparing our audit report for filing, suddenly we saw a shortfall of taxes according to the GSTR-3B. due to this type of mistake first, we will have to pay the taxes and their interest with the help of DRC-03 and after that, we can file our annual return.</li><li><strong>Reconciliation of Statement</strong> &#8211; when an auditor lets you know that you have not paid your full tax liability on the GST portal then first you will have to pay your tax with interest and penalty with the help of DRC-03 and report it in GSTR-9, It should also be reported in GSTR-9C by the GST auditor.</li></ul>

<p class="wp-block-paragraph"><strong>This is Ravi Verma, in this article I will tell you about the late fee and interest of GSTR-3B.</strong></p>



<p class="wp-block-paragraph"><strong>Lets Start,</strong></p>



<p class="wp-block-paragraph">As per the GSTR rules, when a company does not file GSTR-3B by its due date, interest and late fees are levied on the company.</p>

<ul class="wp-block-list"><li><strong>Calculation of Interest.</strong></li></ul>



<h5 class="wp-block-heading">Under GSTR-3B, we can calculate our interest as follows,</h5>

<p class="wp-block-paragraph"><strong>Case 1:-</strong> If we pay tax for January month after the due date of February, then we have to calculate interest according to net liabilities.</p>



<p class="wp-block-paragraph"><strong>***Net Liabilities = Gross liability Tax &#8211; ITC = Net Liability</strong></p>



<p class="wp-block-paragraph"><strong>Example &#8211;</strong> If our tax amount for the month of January is Rs 1,00,000<strong> (Tax 120000 &#8211; ITC 20000 = Net tax 100000)</strong> and our due date is February 22, suppose we pay the tax with a delay of 5 days, then the interest is calculated in the net liability Basic.</p>



<p class="wp-block-paragraph"><strong>Formula:- (Total tax &#8211; total ITC)Net Tax *18%*day / year(365) = Interest amt.</strong></p>



<p class="wp-block-paragraph"><strong>Case 2:-</strong> If we pay tax for the month of January after the month of February, then we have to calculate the interest as per the gross liabilities.</p>



<p class="wp-block-paragraph"><strong>Example &#8211; </strong>If our tax amount for the month of January is Rs <strong>1,20,000 (without ITC <strong>claim</strong>)</strong> and our due date is February 22, suppose we pay the tax with a delay of 1 month i.e March, then the interest is calculated in the gross liability Basic.</p>



<p class="wp-block-paragraph"><strong>Formula:- (120000) Gross Tax *18%*day(08+31=39) / year(365) = Interest amt.</strong></p>



<p class="wp-block-paragraph"><strong>Note point *** </strong>If you are paying your taxes in the same period, the interest tax rate will be 18% and the tax will be calculated as the basic salary of the net liability.</p>



<p class="wp-block-paragraph">If you do not pay your taxes in the same period, pay the tax next month then we calculate the gross liability payment tax and the tax rate is 18%.</p>

<p class="wp-block-paragraph"><strong>Case3:-</strong> If we claim excess ITC for the payment of tax then the interest rate will increase by 24% p.a.</p>



<p class="wp-block-paragraph"><strong>Formula:- 120000*24%*day / 365 = total interest</strong></p>



<h4 class="wp-block-heading"><strong>Calculation of late?</strong></h4>



<p class="wp-block-paragraph">Date of Filing – Due date of Filing * 25Rs = Total late fees.</p>



<h4 class="wp-block-heading"><strong>In case of NIL liability </strong></h4>



<p class="wp-block-paragraph">Date of Filing – Due date of Filing * 10Rs = Total late fees.</p>

Sheets can be opened to see if the loan of the company is short term or long term, we can make it in our online books by making it our company sheets, we can know that there are short term loans and which are long term loans. How much interest is being paid, how much loan is decreasing or loan is increasing?<br>And long term loans are loans that we cannot pay in 12 months which have been loaned for a long time, we can also find out how long the loan has been taken by creating sheets in our Quickbooks online account. For what is taken and how much is paid, how much interest is being paid, how much interest is being taken, we can see all these work in our Quickbooks account</p>
